Terms of Use
These Terms of Use ("Terms") are a legal agreement between you and Photo and Video Applications ("we", "us", "our") for your use of the Quick Notes Android application and related services (the "App"). Please read them carefully. By installing, creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (16 in the European Economic Area, or the minimum age of digital consent in your country) to use the App. If you are under the age of legal majority where you live, you may use the App only with the involvement of a parent or guardian. You must be able to form a binding contract with us and must not be barred from using the App under applicable law.
2. Your Account
- You must provide accurate information when creating an account and keep it up to date.
- You are responsible for keeping your login details confidential and for all activity under your account. Tell us right away if you suspect unauthorized use.
- You may delete your account at any time in the App under Settings > Delete Account. Deletion is immediate and permanent, and your data cannot be recovered (see the Privacy Policy).
3. The App and License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on your Android devices for your own personal, non-commercial purposes, in line with these Terms and the Google Play Terms of Service. The App is licensed, not sold. We and our licensors keep all rights not expressly granted to you.
4. Your Content
- Ownership: you own the notes, checklists, photos, voice notes and other content you create or upload ("Your Content"). We do not claim ownership of it.
- License to operate the App: you give us a limited license to store, encrypt, transmit, back up and process Your Content solely to provide the App to you (for example, syncing your notes). We do not use Your Content for advertising.
- Your responsibility: you are responsible for Your Content and confirm that you have the rights to it and that it does not break the law or anyone's rights.
- Backups: we work to keep your data safe, but you are responsible for keeping copies of anything important.
5. Password-Protected Notes
6. Acceptable Use
You agree not to:
- use the App for anything unlawful, or to store or share content that is illegal, infringing, abusive, defamatory, or that exploits or harms minors;
- attempt to hack, probe, overload, or disrupt the App, our servers or other users' accounts;
- reverse engineer, decompile, modify, or create derivative works of the App, except where the law allows despite this restriction;
- bypass or tamper with security, subscription, advertising or licensing features;
- use bots, scripts or automated means to access the App, or resell or commercially exploit the App without our written permission;
- impersonate another person or misuse another person's account.
7. Permissions, Reminders and Background Features
Some features need device permissions, such as microphone access for voice notes, camera or media access for photos, notifications, and exact alarms for reminders. Voice recording and playback may continue in the background and will show a notification. Reminders depend on your device settings (including battery optimization, notification and alarm permissions), so we cannot guarantee that every reminder will be delivered on time. Do not rely on the App as your only means of remembering time-critical or safety-critical tasks.
8. Advertising
The App may show ads from third parties, including Google AdMob and Meta Audience Network. We are not responsible for the content of third-party ads or for products and services you obtain from advertisers. See our Privacy Policy for how ad data is handled.
9. In-App Purchases and Subscriptions
9.1 How purchases work
The App offers optional paid subscriptions that unlock premium features. All purchases are made and processed through Google Play Billing using the Google account and payment method set up on your device. We do not receive or store your payment card details. Your purchase is also subject to the Google Play Terms of Service.
9.2 Pricing and taxes
The subscription plans, prices, billing period and any free trial or introductory offer are shown in the App and on the Google Play purchase screen before you confirm. Prices include or exclude applicable taxes depending on your country, as displayed by Google Play. We may change prices or plans in the future. Where required, Google Play will notify you of price changes and, if needed, ask for your consent. If you do not agree to a change, you can cancel before it takes effect.
9.3 Automatic renewal
- Subscriptions renew automatically at the end of each billing period (for example, monthly or yearly) at the then-current price, unless you cancel at least 24 hours before the end of the current period, or earlier if Google Play requires.
- Your Google account is charged at confirmation of purchase and at each renewal.
- If a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel before the trial ends. Free trials are usually available once per Google account.
- If a payment fails, Google Play may retry the charge or place your subscription on hold, and premium features may be suspended until payment succeeds.
9.4 How to cancel
You can cancel at any time in the Google Play Store app: Profile icon > Payments & subscriptions > Subscriptions > Quick Notes > Cancel subscription. After cancelling, you keep premium access until the end of the period you have already paid for. Uninstalling the App or deleting your account does not cancel your subscription. You must cancel it in Google Play to stop future charges. We cannot cancel subscriptions on your behalf because they are managed by Google Play.
9.5 Refunds
- All payments are handled by Google, so refunds are decided and issued by Google Play, not by us. We cannot refund money directly to your card or account.
- To request a refund, use the Google Play refund process (Google Play Help > request a refund). Google's policies currently allow you to request a refund within a limited period after purchase (commonly 48 hours), and for later requests Google may direct you to the developer. Please check Google's page for current rules.
- If your request is outside Google's refund window, or you believe you were charged in error, you can email us at the address below with your Google Play order number (GPA.xxxx-xxxx-xxxx-xxxxx), and we will review it. We may approve a refund, or ask Google to process it, at our discretion where permitted by Google's rules and the law.
- Except where required by law, partial-period and unused-time refunds are not provided for a subscription period that has already started.
- Consumer rights: if you are a consumer in a region that gives mandatory rights (such as a statutory withdrawal or "cooling-off" period in the EU or UK for digital content), those rights are not affected by these Terms. Note that by starting to use premium features immediately, you may lose your right to withdraw to the extent the law allows.
- A refunded or reversed purchase (including chargebacks) may lead to the removal of premium access.
9.6 Restoring purchases and multiple devices
Subscriptions are linked to the Google account used to buy them. To restore access on a new device or after reinstalling, sign in to the same Google account in Google Play and use the "Restore purchase" option in the App, or contact us if you have trouble. We verify your subscription status with Google Play, so access may take a short time to update.
9.7 What happens when a subscription ends
If your subscription ends or is cancelled, you return to the free version. Your existing notes are kept, but premium-only features may become unavailable or limited. Where free-plan limits apply, we may restrict adding new content until you are within those limits, but we will not delete Your Content solely because your subscription ended.
9.8 Changes to premium features
We may add, change or remove features over time. We will try to give notice of material reductions to paid features, and you may cancel your subscription if you do not accept them.
10. Third-Party Services
The App relies on third-party services such as Google Play, Google AdMob, Meta Audience Network, Google Analytics for Firebase and Firebase Crashlytics. Their use is subject to their own terms and privacy policies, and we are not responsible for them.
11. Intellectual Property
The App, including its design, code, logos, text and features (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you.
12. Feedback
If you send us suggestions or feedback, you agree that we may use them freely without obligation or compensation to you.
13. Suspension and Termination
You may stop using the App at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, misuse the App, or if required by law. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability and governing law) will continue to apply. Termination does not entitle you to a refund except as stated in Section 9.5 or required by law.
14. Disclaimers
The App is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted, error-free or secure operation. We do not guarantee that data will never be lost, or that sync, backups, reminders, recordings or playback will always work.
15. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, revenue or goodwill, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim arose (or, if you paid nothing, to a nominal amount permitted by law). Nothing in these Terms limits liability that cannot be limited by law, and some jurisdictions do not allow certain limitations, so they may not fully apply to you.
16. Indemnity
You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, Your Content, or your violation of any law or third-party right, to the extent permitted by law.
17. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which Photo and Video Applications is established, without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive jurisdiction over disputes, except where mandatory consumer protection laws give you the right to bring a claim in your local courts. Before starting formal proceedings, please contact us so we can try to resolve the issue informally.
18. Changes to These Terms
We may update these Terms from time to time. We will post the new version here with a new "Last updated" date and, for material changes, notify you in the App or by email. By continuing to use the App after changes take effect, you accept the updated Terms. If you do not agree, stop using the App and delete your account.
19. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger or sale of the business. These Terms and the Privacy Policy are the entire agreement between you and us regarding the App.
